Avalon warrants to Retailer that Products will be free from material manufacturing defects when Products are made available from Avalon to Retailer or an approved carrier for a period of no more than one (1) calendar year from receipt. Damage resulting from improper handling or from exposure to weather or extreme atmospheric conditions or any other cause after Avalon makes Products available to Retailer or an approved carrier is not covered by Avalon's warranty. A Avalon's warranty is expressly in lieu of all other warranties, including any implied warranty of merchantability of fitness for a particular purpose. Avalon shall not be liable for indirect or consequential damages, exemplary or punitive damages, damages for personal injury or injury to other property, or lost sales or profits, for any defect covered by this warranty or otherwise. If any model or sample is shown to Retailer, such model or sample is used merely to illustrate the general type and quality of Products, and not to represent that Products supplied to Retailer will necessarily conform in all respects to the sample or model. Avalon's liability to Retailer for defective Products is limited, at Avalon's option, solely to return and credit at the original invoice price or credit for the pre-approved cost of repair. This warranty may not be assigned and is for the sole benefit of Retailer.
